  1. There is also another type of shooting your own foot. That is talking too much and failing to listen. One of the first things that one teaches young trial attorneys is to listen to what the judge, the opposition, and the prospective jurors are saying before articulating your position. That should be followed only by those points necessary to advance your position. And no more.
